Whether one of those instruments captures the Point Pleasant is a live and material dispute in this county, not a theoretical one.

On deductions, West Virginia's rule protects you: under Wellman and Tawney a deduction clause must expressly provide for the cost, identify the specific deductions with particularity, and state the calculation method, and Romeo v. Antero Resources extended the point of sale rule in June 2025.

Can the operator deduct post production costs from my Wetzel County royalty?
Generally not. West Virginia follows the marketable product rule under Wellman and Estate of Tawney, which requires any deduction clause to expressly provide for it, identify the specific deductions with particularity, and state the calculation method. Romeo v. Antero Resources, decided June 11, 2025, extended the rule to the point of sale. Because Wetzel gas is dry, the processing and NGL piece of Romeo matters less here than in the wet counties, but the underlying rule still protects your check.
