Clay County grew up on coal, the mines that built Brazil, Harmony, and Knightsville in the 1860s, and the oil has always been an afterthought on the northeastern fringe of the basin. Lately it is a slightly bigger afterthought: one operator is drilling Silurian wells in the Clay City field at 2,600 feet, which is deep by Indiana standards, and it has been successful enough to permit disposal wells to handle the water. For a family holding a severed interest around Clay City, that is the first new reason in a long time to find out whether the interest still exists.

**What produces here.** Oil from the Clay City field in the Silurian and from Bowling Green in the Borden Group Carper sand, Devonian, and Muscatatuck, plus scattered shallow stripper wells. Indiana publishes production only statewide, not by county: the Division of Oil and Gas reported 115,486 barrels and 239,449 Mcf for July 2026 and 1,315,471 barrels and 2,887,306 Mcf for all of 2025, and Clay's share is small. The operator in the county records is Adler Energy, with 12 Indiana wells on the state's August 2026 operator list: the 7-30 Fritz permitted to the Silurian in May 2025, the 12-30 Fritz in July and August 2025, the 2-30 Fritz completed as an oil well at 2,645 feet, and three saltwater disposal permits in August 2025, the 8-30 SW Halfhill and 6-30 Foundation into the Salem and the 9-30 Halfhill into the Wabash. The state's April 2025 summary counted three Clay County oil completions. Sunrise Production permitted the SPD 12 Bowling Green West community unit well to the Devonian at 1,455 feet in April 2025.

Whatever you own here, producing royalties, non-producing acreage, or an inherited fraction split among family, we will identify it from whatever paperwork you have, value it off the actual wells and activity, and show you the reasoning with the offer. Free, no obligation, and no pressure: if keeping it is the right answer, we will say so. Inherited it? Questions

## Straight answers for Clay County owners

What are mineral rights worth in Clay County?
It depends on the wells and units actually touching your tract, their decline, and your decimal, and in Clay County that ranges from a new Silurian well in the Clay City field to a severed coal-era reservation nobody has leased since the mines closed, so county averages mislead. Indiana publishes production only statewide, so your check stubs and division orders are the record. We value off the actual wells and activity and show the work, free.

Can my Clay County mineral rights expire?
Yes. The Dormant Mineral Interest Act, Indiana Code 32-23-10, extinguishes a severed mineral interest that goes 20 years without production, lease or royalty payments, taxes paid, or a recorded statement of claim, and it reverts to the surface owner with no advance notice; the U.S. Supreme Court upheld it in Texaco v. Short in 1982. Clay County's coal companies severed minerals all over the county a century ago, and a reservation that has sat idle since the 1990s may already be gone. A statement of claim with the Clay County Recorder before the 20 years run stops the clock, and if a new Clay City well is headed your way, filing it is worth more than any offer.

How fast does a Clay County operator have to pay me?
Indiana has no statute setting a royalty payment deadline or late interest on private leases; the lease governs. With new drilling in the Clay City field, that means the lease you sign is the only thing that decides when your first check arrives and what happens if it is late, so get a payment deadline and an interest rate written in. The petroleum severance tax under Indiana Code 6-8-1-8, the greater of 1 percent of value or 24 cents a barrel and 3 cents per Mcf, comes off before your royalty is figured.

What does it cost me to sell?
Nothing. Berlin pays all title work, document preparation, and recording costs. The offer you accept is the amount you receive.
